DFB HOUSING SOLUTIONS - TERMS OF BUSINESS

1. Treating Customers Fairly

DFB Housing Solutions considers that treating customers fairly is central to the delivery of the services we offer. We are regulated by the Financial Services Authority and, in the event that you have a complaint about us which cannot be resolved between us, you may refer your complaint to the Financial Ombudsman Service. With these things in mind, and understanding your requirement for sensible and effective financial assistance, DFB Housing Solutions aims to provide a fair, comprehensive, clearly explained and supportive service, within a suitable time frame and tailored to meet your specific financial and housing needs.

2. Process

We will use our reasonable endeavours to offer you a Sale and Rent Back solution which meets your needs. However, you must be aware that certain aspects of the transaction are fundamental. Importantly, the value of your home, the amount of equity in it (by this we mean the amount of value left over once the amount of your mortgage has been deducted) the nature and amount of your financial obligations other than to your mortgage lender and agreement and entry of formal legal documentation relating to the sale and rent back of your property.

3. Disclaimer

You acknowledge that you will not be obliged to sell your property to us, and we will not be obliged to buy and rent it back to you, until formal legal agreements relating to that have been signed.

DFB Housing Solutions will compensate you for any loss or damage you may suffer if we fail to carry out our obligations to you to a reasonable standard or if we breach any duties imposed on us by law (including if we cause death or personal injury by our negligence) and you suffer a loss, unless that failure is attributable to:

Your own fault (and this will include, although it is not limited to, your failure to disclose any information to us relating to your financial situation or monies owned under or in connection with a mortgage of your home) a third party unconnected with the provision of services by us, or events which neither DFB Housing Solutions nor any organisation we deal with in connection with you could have foreseen or forestalled, even if we had taken all reasonable care; or any action you may take in relation to a Sale and Rent Back of your home which has been recommended by a person or business other than DFB Housing Solutions;

You acknowledge that there are other suppliers of sale and rent back services and that other solutions other than a sale and rent back with DFB Housing Solutions may exist, and that until you enter into formal legal agreements with us, you are free to pursue any such alternatives. You also acknowledge and agree that DFB Housing Solutions will not be liable to match or otherwise compensate you for any difference between the terms of our offer to you and the terms which are or may be available to you elsewhere.

4. Data Protection Act

The Data Protection Act 1998 requires DFB Housing Solutions to store and deal with your personal information in accordance with strict rules. The Fact Find document contains a statement of how we will store and process your personal information. Please ensure that you read it carefully. Subject to the provisions of the Data Protection Act 1998, DFB Housing Solutions will supply you, at your request, with a copy of the data held by us relating to you, with a description of such personal data and the purposes for which it is processed. DFB Housing Solutions will also provide you with details of the source of that data and any potential recipients of it.

5. Our Charges

We do not charge you a separate fee for our Sale and Rent Back service. The purchase price we offer you and the level of rental payments we agree will incorporate any charges DFB Housing Solutions has made for arranging the sale and rent back.

6. Termination

Either you or we may withdraw from the proposed arrangements at any time before binding legal agreements for the sale and rent back of your property have been entered into.

7. General

Our relationship will be governed by and construed in accordance with English law. We both agree to submit to the jurisdiction of the English Courts.
