Repossession Procedure

The time that the repossession procedure takes can vary significantly depending on the circumstances of the situation and how the court deals with the case. Repossession and any ultimate eviction can be an extremely distressing thing to go through for individuals and their families. It is usually advisable to try and stop repossession.

If you miss a mortgage payment your lender will contact you to try and get the money. When your account is in arrears your lender will require you to agree to a repayment plan in order to clear any outstanding amount. There may also be extra charges or interest when your account is in arrears. If you are unable to clear the arrears or come to an agreement to repay them over time, or if you don't stick to an agreement your lender is likely to pursue further action.

The first step they will take is to request a court hearing where a judge will decide the most appropriate course of action based on your lenders argument and your defence. A typical outcome form the first court hearing is that the judge will recommend a repayment plan.

If after this you are unable to stick to the plan, the lender will apply for a further court hearing. At this hearing if there are no mitigating circumstances then it is likely that the judge will grant possession to the lender and a date will be set for your eviction.
